Pacer Engineering Pty Ltd (ACN 694 113 703), trading as Foxstride (“we”, “us”, “our”), is committed to protecting the privacy of all individuals who interact with our website, products, and services. This Privacy Policy explains what personal information we collect, how we use it, to whom we may disclose it, and the rights you hold over your data.
 

This Policy applies to our website at pacer-engineering.com and all associated subdomains and applications (collectively, the “Service”). By accessing or using the Service you acknowledge that you have read, understood, and agree to the collection, storage, use, and disclosure of your personal information as described in this Policy and our Terms of Service.

We operate under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Where we interact with individuals in the European Economic Area, we apply the standards of the General Data Protection Regulation (GDPR) as a baseline. Where applicable, we also comply with the California Consumer Privacy Act (CCPA) and the California Online Privacy Protection Act (CalOPPA).

• Mailing and billing address

• Payment information (processed and tokenised via PCI-DSS compliant gateways; raw card numbers are never stored on our systems) • Account password (stored as a salted cryptographic hash)

 

3.2 Information collected automatically

• IP address and approximate geographic location

• Browser type, version, and operating system

• Pages visited, time on site, and referring URLs

• Cookie and session data (see Section 9)

 

3.3 Optional mobile device information

With your explicit permission our mobile application may access your device contacts list to improve usability. This permission can be revoked at any time through your device settings.

 

3.4 Information from third parties We may receive information from fraud-detection providers, social media platforms (only information you have made publicly available), and analytics partners. You can limit what social platforms share by adjusting your privacy settings on those platforms.

 

4. How We Use Your Information

We use personal information only for the purposes for which it was collected, including:

4.1 Email communications By providing your email address you consent to receive transactional and, where opted in, marketing emails from us. Every marketing email includes a clear unsubscribe link. We do not send unsolicited commercial electronic​ messages. Where permitted by law we may use hashed email addresses for custom audience matching on advertising platforms such as Meta, but only where you have consented to marketing communications.

 

5. Disclosure of Your Information to Third Parties

We do not sell your personal information. We may share personal information in the following limited circumstances:

› Service providers — Hosting, database, email delivery, payment processing, and fraud-detection providers contractually bound to handle data only on our instructions.

› Analytics partners — Anonymised or aggregated log data (including hashed IP addresses) shared with web analytics providers.

› Advertising platforms — Hashed email addresses shared with platforms such as Meta for custom audience advertising, only where you have consented to marketing.

› Corporate affiliates — Entities that directly or indirectly control, are controlled by, or are under common control with Pacer Engineering, subject to this Policy.

› Business transfers — In the event of a merger, acquisition, asset sale, or insolvency, your information may be transferred to a successor entity that agrees to honour this Policy.

› Legal obligations — Disclosure to law enforcement, regulators, or courts where required or permitted by Australian law, or to protect the rights, safety, or property of the Company, our users, or the public.

 

6. International Transfers of Personal Information

We are incorporated in Australia. Some third-party service providers may be located in, or process data in, countries other than Australia. Where personal information is transferred internationally we take reasonable steps to ensure it is protected to a standard at least equivalent to the Australian Privacy Principles, including using contractual data-protection obligations with overseas recipients (APP 8).

7. Data Retention

We retain personal information only for as long as necessary to fulfil the purposes described in this Policy, or as required by law:

 

Active account data Retained for the duration of your account plus 7 years to satisfy Australian tax, accounting, and legal obligations.

 

Transaction records 7 years from the date of transaction (Corporations Act 2001 (Cth)).

 

Marketing consent records Until consent is withdrawn, plus 5 years to evidence compliance.

 

Support and correspondence 3 years from resolution, unless longer retention is required by law.

 

After account deletion Active databases de-identified or deleted within 60 days of a verified deletion request, subject to mandatory legal retention obligations.

 

Backup and archival copies May persist for up to 12 months; not actively used to identify you.

 

8. Security of Your Information

We implement appropriate technical and organisational measures to protect personal information, including:

• TLS/SSL encryption for all data in transit

• Encryption of sensitive data at rest

• Payment card data processed exclusively via PCI-DSS compliant gateways; raw card numbers are never stored by us

• Role-based access controls and least-privilege principles

• Regular security reviews and penetration testing

No security system is impenetrable. While we apply commercially reasonable safeguards we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

 

9. Cookies and Tracking Technologies We use the following technologies to enhance functionality and understand how the Service is used:

› Session Cookies — Temporary cookies that expire when you close your browser; used to maintain login state during a visit.

› Persistent Cookies — Cookies that remain between sessions to remember your preferences and settings.

› Analytics Cookies — Collect aggregated, anonymised data about how visitors use the Service.

› Local Storage — Client-side storage used to save application state locally on your device.

› Google Maps API — Where map features are enabled, Google Maps may collect device and usage information per Google's own Privacy Policy.

11.1 Australian residents — Australian Privacy Principles

Under the Privacy Act 1988 (Cth) you have the right to:

• Access the personal information we hold about you (APP 12)

• Request correction of inaccurate, out-of-date, or incomplete personal information (APP 13)

• Opt out of direct marketing communications (APP 7)

• Complain to us about a breach of the APPs, and escalate to the OAIC if unresolved

 

11.2 EEA residents — GDPR If located in the European Economic Area, you additionally have the right to:

• Receive a copy of your personal data in a structured, machine-readable format (data portability)

• Request erasure of your personal data (‘right to be forgotten’), subject to legal retention obligations

• Restrict or object to processing in certain circumstances

• Lodge a complaint with your local supervisory authority

 

11.3 California residents — CCPA / CalOPPA California residents have the right to know, access, and delete personal information we have collected, and to equal service without discrimination. We do not sell personal information. To exercise your rights contact us at Section 14. We will respond within 45 days.

 

11.4 Exercising your rights To make an access, correction, deletion, or opt-out request, contact us as detailed in Section 14. We may require identity verification before processing your request and will respond within 30 days (or within the timeframe required by applicable law).

 

12. Children’s Privacy

The Service is not directed to individuals under 13 years of age. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided personal information without consent, please contact us immediately and we will delete that information promptly.

 

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated Policy with a revised effective date and, where appropriate, by email or in-Service notification. Continued use of the Service after the effective date constitutes acceptance. If you do not agree, you may close your account.

 

14. Governing Law and Jurisdiction

This Privacy Policy is governed by the laws of New South Wales, Australia. Any dispute arising under this Policy shall be subject to the exclusive jurisdiction of the courts of New South Wales, unless mandatory local law provides otherwise.
